Terms of Service

These terms apply to your use of the TekTalk Support website and services. By ordering or using our services you agree to them.

1. Definitions

“TekTalk”, “we” and “us” mean TekTalk Support. “Customer” or “you” means the business or person that orders or uses our services. “Services” means TekTalk’s AI and human answering and virtual receptionist services, AI web chat, outbound calling and messaging campaigns, AI calling, business automation, and managed IT support, as described in your plan or order.

2. Plans, billing and free first month

Plans are billed monthly in advance until cancelled. New customers receive their first month free. You may cancel at any time before your next billing date to avoid further charges by emailing info@tektalksupport.com or calling 1-800-280-9085. Prices are listed on our website and may change with notice.

3. 14-day money-back guarantee

If you are not satisfied, you may request a full refund within 14 days of your first paid charge. Contact us using the details above.

4. Customer responsibilities for calls and texts

You are responsible for having valid consent and a lawful basis to contact every person through our outbound calling, AI calling and texting services. You must comply with all applicable laws, including the US Telephone Consumer Protection Act (TCPA) and state telemarketing rules, Canada’s CRTC Unsolicited Telecommunications Rules and National Do Not Call List, and Canada’s Anti-Spam Legislation (CASL). You must provide accurate contact lists and honour all opt-out requests immediately.

5. AI disclosure

Calls and messages made by AI will identify themselves as AI where required by law or our policies. You may not instruct the services to impersonate a real person or misrepresent who is calling.

6. Call recording

Calls may be recorded and transcribed to provide and improve the services. Our standard greeting includes a recording notice. You are responsible for any additional notices or consents required by law for your callers.

7. Acceptable use

You must follow our Acceptable Use Policy at tektalksupport.com/acceptable-use. We may suspend or terminate services that violate it.

8. Service quality and accuracy

We work to answer calls and chats accurately and promptly, but AI and human services can make mistakes. We do not guarantee error-free or uninterrupted service. You are responsible for reviewing messages, summaries and appointments we handle for you.

9. Managed IT support

Where your plan includes managed IT support, we provide remote technical assistance for the devices and systems covered by your plan. You agree to give accurate information and appropriate access, and to keep your own backups. We are not responsible for data loss or issues caused by hardware failure, third-party software, or actions taken by you or others.

10. Third-party services

Our services rely on third-party providers such as telephony, AI, payment and chat platforms. We are not responsible for outages or changes outside our reasonable control.

11. Limitation of liability

To the fullest extent permitted by law, TekTalk is not liable for indirect, incidental or consequential damages, or for lost profits, revenue or business opportunities. Our total liability for any claim is limited to the fees you paid us in the three months before the claim arose.

12. Termination

You may cancel at any time. We may suspend or end services if you breach these terms, fail to pay, or use the services unlawfully.

13. Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there.
